Resolution of the issue or concern (NOTE: Please describe what actions you have taken) Hello Mr. Poland, I am Sarah Peelman, the Arborist for the City of Erie. If you have a dead tree is between the sidewalk and the curb, it is in the city right-of-way. Before removing a tree within the right-of-way, it is necessary to fill out a permit application. I am attaching one for your convenience. Please print it out, fill in the requested information, then mail or email it back into me. In the City of Erie, any tree that is between the sidewalk and the curb is in the City Right-of-Way. What people are sometimes unaware of is that even though a tree is in the City right-of-way, it is still the responsibility of the abutting homeowner to care for it, just like it is the property owners' responsibility to mow the grass and shovel and maintain the sidewalks. The City does however try to help homeowners remove dead and/or dying trees through our Urban Forest Program. Due to so many people requesting City help, there are currently over 200 people on the waiting list with about a five year wait. Upon approval of your permit, if you choose to pay and have the tree removed at your own expense, you may contact any professional tree company such as those listed in the phone book. They all should be willing to provide you with quotes free of charge. Once you have an approved permit, you may hire whomever you choose to begin work at your convenience. However, I do recommend verifying that they are fully insured. If you would like to request that the City remove the tree for you, you may do so, however, there is a long waiting list with over two hundred trees on the list. Because of so many requests for trees to be removed, the City only removes dead and severely dying trees. I hope this helps answer some of your questions.
